Domain Registration Agreement

Terms and Conditions

The following Domain Registration Agreement Terms and Conditions form an integral part of the main Terms of Service ("TOS") of Skyva Tech Inc.

Throughout this Agreement:

"Skyva Tech", "we", "us", or "our" refers to Skyva Tech Inc.

"You", "Your", or "Registrant" refers to the customer purchasing domain name registration services, including any authorized representative acting on your behalf.

1. Scope of Agreement

This Domain Registration Agreement ("Agreement") sets forth the terms and conditions governing your use of domain name registration services and related services ("Services") provided by Skyva Tech.

The rights and responsibilities associated with domain name registration

When You use your account, or permit another party to use your account, to purchase, manage, transfer, renew, or cancel domain name Services (whether or not Skyva Tech was notified of such authorization), You remain fully responsible for all actions taken under your account.

2. Customer (Registrant) Information Requirements

As part of the domain name registration process, You must provide and maintain accurate and complete information, including:

Full legal name and postal address of the Registrant

The registered domain name

Administrative contact information (name, address, email, phone)

Technical contact information

Billing contact information

Primary and secondary nameserver details

You agree to promptly update this information during the registration term.
Providing false, misleading, or incomplete information may result in suspension, cancellation, or transfer of the domain name.

3. Domain Name Renewal Terms

3.1 Automatic Renewal (Default Setting)

By default, domain names are set to automatically renew for a period equal to the original registration term.
For example:

A one (1) year registration will renew for one (1) year.

A two (2) year registration will renew for two (2) years.

Renewal fees will be charged to the payment method on file at Skyva Tech's then-current rates.

3.2 Manual Renewal

If You disable automatic renewal, You are solely responsible for manually renewing your domain before its expiration date via your client portal or by contacting support.
Failure to renew before expiration may result in:

Suspension

Cancellation

Permanent loss of the domain name

Skyva Tech will send renewal reminders and invoices via email prior to expiration; however, You remain fully responsible for ensuring timely renewal.
Skyva Tech shall not be liable for expired or cancelled domain names due to non-payment or failure to renew.

3.3 Redemption Grace Period

If a domain name is deleted after expiration, the registry may provide a Redemption Grace Period (typically 30 days).
During this period, You may restore the domain by paying the applicable redemption fee.
Redemption fees are determined by the registry and may change at any time.
If the domain is not redeemed within the registry's redemption period, it will be released and may become available for public registration.
Redemption periods vary depending on the TLD (Top-Level Domain). Specific registry rules govern each TLD.

4. Domain Transfer Terms

Domain transfers are governed by ICANN's Transfer Policy (as amended from time to time)

4.1 Transfer Process

To transfer a domain:

You must unlock the domain

Obtain the EPP/Auth Code

Approve transfer authorization emails

Transfers typically take up to five (5) business days.
Transfers cannot occur:

Within 60 days of initial registration

Within 60 days of a previous transfer

If there is a dispute over ownership

If payment is overdue

If required by ICANN policy

If a transfer is initiated near expiration, You assume all risks related to potential transfer failure.

4.2 Registrar Lock

Skyva Tech may place a "Registrar Lock" on domain names to prevent unauthorized transfers. While a domain remains locked, all transfer requests are considered expressly denied until unlocked by You.

4.3 Data Responsibility

Skyva Tech is not responsible for:

Lost data

Website downtime

Email disruption

File corruption

resulting from domain transfers to or from our services.
You are solely responsible for backing up all associated data.

5.Registrant Obligations

You agree to comply with:

All ICANN policies

Registrar policies

Registry operator rules

Applicable dispute policies

You acknowledge that:

Registration does not grant immunity from objections or disputes

Registrars and registries retain authority over domain management

You agree to indemnify and hold harmless Skyva Tech from any claims arising from:

Your non-compliance

Inaccurate registration information

Violation of ICANN or registry rules

6. Dispute Policies

You agree to be bound by:

ICANN's Uniform Domain Name Dispute Resolution Policy (UDRP)

Any applicable Registry Dispute Resolution Policy (RDRP)

Registrant Rights and Responsibilities as defined by ICANN

These policies may be amended from time to time.

7. Rights of Skyva Tech and Registry

Skyva Tech and/or the Registry reserve the right to suspend, lock, transfer, modify, or cancel a domain registration in order to:

Comply with ICANN policies

Comply with court orders or law enforcement requests

Correct inaccurate or fraudulent registration information

Resolve disputes

Prevent legal liability

Enforce this Agreement

Neither Skyva Tech nor the Registry shall be liable for actions taken in accordance with such policies.

8. Liability Limitation

Skyva Tech shall not be liable for:

Failure or refusal of a registry to register, renew, transfer, or delete a domain.

Domain suspension or cancellation.

Processing delays.

Registry errors.

Loss of profits.

Indirect, incidental, or consequential damages.

This limitation applies regardless of whether claims arise under contract, tort (including negligence), or otherwise.

9. Payments and Fees

All domain registration and renewal fees:

Must be paid in advance

Are non-refundable unless otherwise stated

Remain payable even if Services are suspended or cancelled

Skyva Tech reserves the right to change pricing at any time.

10. Cancellation

Domain registrations may be suspended, cancelled, or transferred if:

You breach this Agreement

Payment is not received

Contact information is inaccurate

ICANN or registry policy requires it

Law enforcement or court order requires it

There was an error during registration

A dispute resolution decision mandates transfer or cancellation
